Building violations are regulated by the recently introduced Law 4495/2017.
The new law regarding buildings without permits replaced the previous ones (Laws 4178/2013 and 4014/2011). The “regularization” process is done online without having to deal with the town planning authority. Buildings and building components which were constructed before 28/07/2011 can be regulated.
The stages required to regulate a building under Law 4495/2017 are:
- Inspection of the property, recording any building violations / differences between the existing conditions in relation to the building permit plans. Depending on the form of the infringement, a building survey is conducted.
- Drawings of the property are produced with the building violations highlighted.
- The mandatory fine is calculated on the online platform provided by the “TEE” (Technical Chamber of Greece). The fine is calculated on the basis of the violation’s surface, the land value, the date the violations were made and the area’s the zoning. Finally, it is also derived from specific factors related to each infringement while also taking into account social factors which reduce the fine.
- An online application / statement is submitted through the TEE's online platform.
- Once the total fine has been calculated and the online statement is completed, an initial deposit must be paid. This initial deposit of the fine varies, beginning at 250 euros. By paying this first installment, the violations are officially incorporated into the law. The remaining fine is then paid either in monthly installments or all at once with a 20% discount or a combination of the two methods where a 10% discount is provided.
- The process is completed when the final payment of the fine is made and the information required by our firm (drawings, technical report, type of structural engineering report, etc.) is submitted.
When at least 30% of the fine has been paid, the declaration is in the process of 'definitive entry'. Under this condition, a relevant certificate is issued by the Ministry of Environment, Energy and Climate Change which can allow the property to be connected to the utility networks or for a notarial deed to be drawn up.
